1. Competition Rules
The competition regulations of the German Triathlon Union DTU apply to the event. The participant, the legal guardians, the authorized trainer and teacher expressly agree to these.
2. Conditions of Participation
2.1. Only those who have properly registered, have accepted the General Terms and Conditions and have read, understood and personally accepted the conditions of participation with their own signature, and are in possession of an official start number for the triathlon.de CUP, are allowed to participate.
2.2. Club membership is not required.
2.3. Each competitor must attend the mandatory race briefing. In addition, the instructions in the competition/starting information and on the homepage, which also point out danger spots, among other things, must be read through. However, the listing of the danger spots shown there is not exhaustive.
2.4. Only those who are in good health are allowed to participate. The ability to participate must be certified by a doctor for each participant.
2.5. The physical suitability of the underage participants and the consent of the legal guardians must be confirmed by their own signature when picking up the starting documents. This does not apply if the registration is made via a school/association. The school/club must have written consent from the legal guardians.
3. Participant Obligations
3.1. Each participant must ensure that they have proper and functional equipment and must wear a helmet that complies with DTU regulations while cycling.
3.2. The instructions and specifications of the organizer and the instructions of the assistants must be followed. In the event of violations that disrupt the proper course of the event or endanger the safety of the participants, the organizer is entitled to exclude the participant concerned at any time.
3.3. The race takes place in public street space. The provisions of the Road Traffic Act, including all related regulations, in particular the Road Traffic Act, apply. The participant is obliged to observe these regulations. The legal guardians, the authorized trainer and teacher expressly point this out to him.
3.4. All nature, landscape and animal protection regulations must also be observed.
4. Conclusion of contract
4.1. The participant acquires a right to participate only after the participation fee has been transferred. Each participant can only register once, ie if the same person registers twice, there is no entitlement to a second starting place or a refund of the entry fee.
4.2. The contract is concluded when the participant, the legal guardian, the authorized trainer and teacher have expressly accepted the general terms and conditions and the competition regulations of the DTU by clicking on them.
4.3. In the event of non-payment by the day of the event, the organizer reserves the right to remove the registered person from the start list. However, the organizer retains full entitlement to the participation fee.
4.4. The organizer reserves the right to charge a late registration fee after the registration deadline.
4.5. All fees include the organizer fee to the triathlon association.
5. Entry documents
5.1. The participant will only receive his starting documents upon presentation of his identity card/passport.
5.2. If the participant is unable to attend, he must ensure that the starting documents are picked up by a person authorized in writing. The documents will not be sent.
5.3. Parents/guardians/club trainers and teachers of participating underage children/pupils will only receive the starting documents upon presentation of their identity card/passport and written confirmation of authorization and acceptance of the competition and participation conditions.
6. Withdrawal by the participant, exchange of starting places
6.1. In the event of non-participation, the entry fee will not be refunded. A right to start for the following year is not possible.
6.2 Withdrawal is only possible up to and including 30 days before the event. After this point in time, withdrawal is not possible. A processing fee of EUR 20 will be charged in the event of withdrawal or an exchange of starting places.
6.3 Only in the event of withdrawal before the deadline specified in 6.2 will the entry fee be refunded minus the processing fee of EUR 20. If the processing fee exceeds the entry fee, there will be no refund. Thereafter, no refund will be made.
7. Cancellation and changes to the event, non-attendance
If the event is canceled or changed due to force majeure, official orders or for safety reasons, the participant has no right to compensation for other damages, such as travel costs or hotel costs.

Additional services that are subject to a charge (e.g. T-shirts, backpacks, etc.) that have already caused costs to the organizer at the time of cancellation will not be reimbursed but issued to the participant. If the processing fee exceeds the entry fee, there will be no refund.
If you do not show up, any claim will be forfeited.
8. Liability
8.1. Participation is at your own risk.
8.2. The liability of the organiser, organizers and helpers is limited to intent or gross negligence. However, the exclusion does not apply to liability for damage resulting from injury to life, limb or health that is based on a negligent breach of duty by the organizer or an intentional or negligent breach of duty by a legal representative or vicarious agent of the organizer. The exclusion of liability also does not apply to other damages based on a grossly negligent breach of duty by the organizer or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the organizer.
8.3. The organizer is not liable for items of equipment lost in the transition area or for other lost items belonging to the participants.
8.4. Upon receipt of the start number, the participant, the legal guardians, the authorized trainer and teacher declare in a binding manner that there are no health concerns about their participation. The participant has to take care of an appropriate health, accident and liability insurance cover himself.
8.5. The participant, legal guardian, authorized trainer and teacher are aware that participation in the triathlon competition involves dangers and that the risk of serious injuries, including fatal accidents and damage to property cannot be ruled out.
8.6. The participants bear the costs incurred when using rescue services and the like.
8.7. The adult participant himself / in the case of underage participants the legal guardian, the authorized trainer / teacher must confirm with his signature when collecting the starting documents that he has read and understood the competition and participation conditions and the regulations and fully accepts them.
8.8. The duty of supervision is transferred back to the legal guardian, the authorized trainer and teacher once the goal has been reached or the participant has left the race. The participant will be welcomed back at the finish by the legal guardian, the authorized trainer and/or teacher.
9. Data Collection and Data Utilization
9.1. The participant, the legal guardian, the authorized trainer and teacher agree that the data specified in the registration may be recorded and passed on and published in connection with photos, film recordings and interviews made at the event without any claim to remuneration and may be used by the organizer.
9.2. The participant, the legal guardians, the authorized trainer and teacher agree to the transfer of their personal data for the purpose of sending photos of the participant during the competition, which are produced by a company commissioned by the organizer.
10. Jurisdiction
10.1. The exclusive place of jurisdiction for all claims in connection with this event is Munich (also for participants from abroad).
10.2. German law applies exclusively.
11. Final Clause
If individual provisions of these General Terms and Conditions are or become invalid, this shall not affect the validity of the remaining provisions. The parties are obliged to agree on a new provision that comes as close as possible to the purpose of the provision that has become invalid.
